The Fit and Proper determination, Board Notice 194 of 2017 defines regulatory examination as an examination based on the qualifying criteria set out in the Tabes in Annexure Five, the purpose of which is to test a person’s knowledge, understanding and application of legislation, including a financial sector law as defined in section 1(1) of the Financial Sector Regulation Act, 2017 the Financial Intelligence Centre Act 2001 and all measures promulgated in terms of those Acts, directly applicable to an FSP, representative or key individual.
